Fort Erie Recreational Park Fined $ 60,000 for Discharging Sewage to the Ground

St. Catharines - Fort Erie Recreational Park has been fined $60,000 for discharging sewage waste on land likely to cause an adverse effect, contrary to the Environmental Protection Act.

1431344 Ontario Inc. owns and operates a recreational park located on Niagara Parkway, Fort Erie, known as Frenchman's Creek R.V. and Camping.  Mohammed Abdul Hafeez is the Director of the company that purchased this site in May of 2009. The recreational park has sites for recreational vehicles, camping, on site cabins and a small two storey motel on about 10 acres of land. The site's sewage is serviced by several septic systems located around the property.

On August 19, 2013, a Provincial Officer of the ministry and a Niagara Regional Health Inspector attended the camp site and spoke with Mr. Hafeez concerning the discharge of sewage which is both an environmental and human health concern.  At this time there were approximately 15 residents on site.

Sewage was observed discharging directly from an R.V. trailer to the ground with evidence that this discharge had been ongoing. There was also a storage tank directly discharging sewage to a ditch along a roadway.  This ditch flows to the Niagara River on the east side of the Niagara River Parkway near a public boat launch.

On August 29, 2013, the officer returned to the site and observed that the R.V. trailer was still discharging sewage directly to the ground and had not been connected to the sewage holding tank as requested.

As a result of the ongoing sewage discharges, the entire site was ordered closed by the Niagara Regional Medical Officer of Health and all residents were required to vacate the premises by October 2, 2013. The Town of Fort Erie shut off the water supply to the site on October 2, 2013.

The company was fined $50,000 and Mr. Hafeez $10,000 for a total of $60,000 plus a victim fine surcharge totaling $ 15,000 and each given nine months to pay the fines.
